DISTRICT COURT OF THE UNITED STATES WESTERN DISTRICT OF MISSOURI WESTERN DIVISION United States -vs- Marie Ogden, Joseph Maher and Don Depasco No. 13676 United States -vs- Gene Riley, Irene Irvin, Robert Strohm and Thomas Audley No. 13739 United States -vs- Ellis Buck, Sam Brenner, Ernest Williams and Herman Supofsky No. 13754 United States -vs- Weeden Henderson, Glenn Barnard and Frank P. Dixon No. 13755 ORDER The above-named defendants have dismissed their respective appeals taken to, and pending before, the United States Circuit Court of Appeals for the Eighth Judicial Circuit so that the sentences originally imposed upon the respective Judgments of conviction might be set aside and new sentences imposed by this court. The mandates of the United States Circuit Court of Appeals for the Eighth Judicial Circuit remanding their several cases have now been received and filed by the clerk of this court. THEREFORE, IT IS ORDERED AS FOLLOWS: (1) That the sentences now standing against said defendants, and each of them, be and they hereby are set aside, but solely for the purpose of resentencing said defendants and each of them. (2) That the modified sentences to be imposed on said defendants, and each of them, be entered and imposed upon the condition that the fines imposed in said modified sentences be paid to the clerk of this court on July IS, 1938, and jurisdiction is reserved to set aside said modified sentences and to impose other sentences in the event said fines be not so paid.
