(1) State of Missouri County of Lawrence Be it remembered that on the 18th day of October 1865, was filed a petition in the office of the Clerk of the Circuit Court of the County of Lawrence State of Missouri. Which said petition is in the words and figures following to Wit: State of Missouri County of Lawrence In the Circuit Court of Said County Nov Term 1865 George F. Bowers John J. S. Bowers William H. Bowers Plaintiffs vs Harvy [Harvey] T. McCune Defendant Plaintiffs State they were the owners of a large merchant Grist mill & carding machine and woolen manufacturing Situated in Said County and that on or about the 5th day of October AD 1865 [1863]. Description | This civil court case between the owners of the Bowers Mill, George F., John J. S. and William H. Bowers, plaintiffs, and defendant Harvy T. McCune was to determine whether McCune was responsible for the burning of the mill and it's related buildings on October 5, 1863. [The clerk incorrectly wrote 1865.] Harvy T. McCune died during the course of the lawsuit and his wife was named as defendant, since she was the administratrix of his estate. |

Description | On October 18, 1865 a petition was filed by George F. Bowers, John J.S. Bowers and William Bowers against plaintiff Harvy T. McCune. The suit was filed in Lawrence County, MO and involved the burning, on October 5, 1865 [1863], of the Bowers' grist mill, carding machine and woolen manufacturing concern, all located in the town of Oregon in Lawrence County, MO. The Bowers contend that a group of Rebel soldiers led by General Joseph Shelby actually burned the mill and other buildings, but that Harvy T. McCune motivated them to do it. The Bowerses ask for damages in the amount of $32,000. Sherwood and Young are the attorneys for the plaintiff and George F. Bowers is agent for the other plaintiffs. |
