112 continued an act further to prevent smuggling and for other purposes se it enacted by the senate and mouse oft representatives of the united states of america in congress assem bled that for the purposes of this act the term vessel whenever herein after used shall be held to include eyfery description of water craft raft vehicle and contrivance used or capa ble of being used as a means ot aux iliary of transportation on or by water*.and the term vehicle whenev er hereinafter used shall be held to include evry description of carriage wagon engine car sleigh sled i sledge hurdle cart and other ai-tifi i cial contrivance used or capable of being used as a means or auxiliary of tarusportation on land sec 2 and be it further enacted that it shall be lawful for any officer of the customs including inspectors and occasional inspectors or of a revenue cutler or authorized agent of the treasury department or other person specially appointed for the purpose in writing by a collector tiaval officer or surveyor of the cus toms to go on board of any vessel as well without as within his district and inspect search and examine the same and any person trunk or en velope on board and to this end to hail and stop such vessel if under way and to use all nedessary force to compel compliance and if it shall appear that any breach or violation of the laws of the united slates has been.committed whereby or in con sequence of which such vessel or the goods wares and merchandise or any part thereof on board of or imported by such vessel is or are lia ble to forfeiture to make seizure of the same or either or any part there of and to arrest or in case of escape to pursue and arrest any person en gaged in such breach or violation provided that the original appoint ment in writing of any person spe cially as aforesaid shall be filed in the custom house where such appoint ment is madei sec ' 3 and be it further enacted that any of the officers or persons \ authorized by the second section of i this act to^board or search vessels j may stop search and examine as | well without as within their raspec ! tive districts any vehcle beast or person on which or whom he or they shall suspect there are goods wares or merchandise which are subject to duty or shall have been introduced in to the united states in any manner contrary to law whether by the per son in possession or charge or by : in or upon such vehicle or beast oi otherwise and to search any tfdnk or envelope wherever found in which he may have a reasonable ; cause to suspect there are goods which were imported contrary to law and if any such office or per son so authorized as aforesaid shall find any goods wares or merchan dise on or about any such vehicle beast or person or in any such trunk or envelope which he shall have reasonable cause to believe are sub ject to duty or to have been unlaw fully introduced into tbe united states whether by the person in possession or charge or by in or upon such vehicle beast or other wise he shall seize and secure the same for trial and every such vehi [ cle and beast or either together : with teams or other motive power i used in conveying drawing or pro | pelling such vehicle goods wares or merchandise and all other appurten ances including trunks envelopes covers and all means of conceal ment and all the equipage trap pings and other appurtenances of such beast team or vehicle shall be subject to seizure and forfeiture and if any person who may be driving or conducting or in charge of any such carriage or vehicle or beast or any person travelling,shali wilfully refuse to stop and allow search and exami : nation to be made as herein provided when required so to do by any au thorized person be or she shall on conviction be fined in any sum in the discretion of the court convict ing him or her not exceeding one thousand dollars nor less than fifty dollars and the secretary of the treasury may from time to time proscribe regulations for the search of persons and baggage and tor the employment of female inspectors for for the examination and search of persons of their wn sex and all persons coming into the united states from foreign countries shall be liable to detention and search by authoriz ed officers or agente of the govern ment under such regulations as the secretary of the treasury shall from time to time prescribe provided that no railway car or engine or other vehicle or team used by any person or corporation as common carriers in the transaction of their business as such common carriers shall be subject to forfeiture by force of the provisions of this aot unless it shall appear that the owners su perintendant or agent of the owner in charge thereof at the time of such unlawful importation or transporta tion thereon or thereby was a con senting party or privy to such ille gal importation or transportation see 4 and be it further endted that if any pel-sen shall fraudulent ly or knowingly import or bring into the united states or assist in so do ing any goods wares or merchan dise contrary to law or shall receive conceal buy sell or in any manner facilitate the transportation conceal ment or sale of such goods wares or merchandies after their importa tion knowing the same to have been imported contrary-to law such goods wares and merchandise 6hall be for feited and he or she shall on con viction thereof before any court of competent jurisdiction be fined in any sum not exceeding five thousand dollars nor less than fifty dollars or be imprisoned for tny time not exceeding two years or both at the discretion of such court and in all cases where the possession of 4jieh goods shall be shown to be in the de fendant or where the defendant shall be shown to have had possession thereof such possession shall be deetited evidence sufficient to author ize conviction unless the defendant shall explain the possession to the satisfaction of the jury sed 5 and be it further enacted that any person authorized by this act to make searches and seizures ot any person assisting hitn ot acting under his directions may if deemed necessary by him or them enter into or upon or pass through the lands enclosures and building's other than the dwelling-bouse of any person whomsoever in the night or in the daytime in order to the more effec tual discbarge of bis or their official duties sec 6 and be it further enacted that if ariy person shall forcibly as sault resist oppose prevent impede or intorfere with any officer of the customs or his deputy r deputies or any person assisting them or either of them in the execution of their du ties or any person authorized by this act to make searches or seizures in the execufiin of his duty or shall rescue or attempt to rescue or cause to be rescued any property which shall have been seized by any person authorised a aforesaid or shall be fore at or af er any such seizure in order to prevent the seizure or seeur ing of any goods wares or merchan dise by any person authorized as afyresaid stave break throw ovor ; board destroy or remove the same the person so offending shall for eve ry such offence on conviction there of forfeit and pay a»sum of not less than one hundred dollars nor more than two thousand dollars or shall be imprisoned not less than one month nor more than one year or both at the discretion of the court convicting him or her and shall stand committed until such fine and the costs of prosecution shall have been fully paid and if any person shall discharge any deadly weapon at any person authorized as aforesaid to make searches or seizures or shall use any deadly or dangerous weapon in resisting him in ihe execution of his duty with intent to commit a bodily injury upon him or to deter or prevent him from discharging his duty every such person so offending shall upon conviction thereof be deemed guilty of felony and ehall be imprisoned at hard labor for a term not exceeding ten years nor less than one year sec 7 and be it further enacted that it shall be the duty of the seve ral collectors of customs to report within ten days to tho district attor ney of the district in which any fine or personal penalty may be incurred for the violation of any law of the united states relating to the reve nue in all cases in which such fine or penalty shall not be voluntarily paid a statement of all the facts and cir cumstances of the case within their knowledge together with the names of the witnesses and which may come to their knowledge from time to time stating the provisions of the law believed to be violated and on which a reliance triay be had for a condemnation or conviction and such district attorney shall cause suit and prosecution to be commenced and prosecuted without delay for the fines and personal penalties by law in such cases provided unless upon inquiry and examination be shall de cide that a conviction cannot proba bly be obtained or that the ends of public justice do not require that a suit or prosecution should be insti ] tuted in which case he shall report ; the facts to the secretary of the i treasury for his direction and for expenses incurred and services ren dered in prosecutions for such fines anxi personal penalties the district attorney shall receive such allowance as the secretary cf the treasury shall deem just and reasonable upon the certificate of the judge before whom such prosecution was had and if any collector shall in any case fail to re port to the proper district attorney as prescribed in this section such col lector's share of any fine or penalty imposed or incurred in such case shall be forfeited to the united states and the same shall be awarded to such persons asr may make complaint and prosecute the same to conviction sec 8 and be it further enacted that in any case where a vessel or the owner master or manager of a vessel shall be subject to a penalty for a violation of the revenue laws of th united states such vessel shall be holder for the payment of th j penalty and may be seized and pro ceeded against summarily by libel td recover such penalty in any dis trict court of the united states hav ing jurisdiction of the offence sec 9 and be it further enacted that the act entitled an act further | to regulate the entry of merchandise imported into the united states from | any adjacent territory approved march two eighteen hundred and twenty-one be and the same is here by so amended that wherever iii aaid act the word merchandise occurs the same shall read goods wares or merchandise sfic 10 and be it further enacted that every officer or other person authorized to make searches and ceizuros by this aot shall at the time of executing any of the powers con ferred upon him by this act make known uptm being questioned his character as un officer or agent of the ! customs or government and shall i have authority to demand of any person within the distance of three i miles to assist him in making any ar rest search or seizure authorized by this act where such assistance may be necessary and-if suchpersor.shall without reasonable excuse neglect or refuse so to assist upon proper de mand he shall be deemed guilty of a misdemeanor and shall forfeit a sum not exceeding two hundred dollars nor less than five dollars sec 11 and be it further enacted that in au cases of seizure of proper ty subject to forfeiture for any of the causes named in this act or any oth er aot relating to the customs or the registering enrolling or licensing of vessels now in force when in the opinion of the collector or other prin cipal officer of the revenue making such seizure the value of the proper ty so seized shall not exceed five hun dred dollars he shall cause a list and particular description of the property so seized to be prepared tn duplicate and an appraisement of the same to be made by two sworn appraisers under the revenue lawsj if there are such appraisers at or near the place of seizure but if there are nd such appraisers then by two competent and disinterested citizens of the uni ted states to be selected by hirri for that purpose residing at or near the place of seizure which list and ap pr-aisement shall be properly attested by such collector or other officer aod tht persons making the appraisal and for such services of the apprais ers they shall be allowed out of the revenue one dollar and fifty cents each for every day necessarily era ployed in such service if the amount of such appraisal shall not exceed the sum of five hundred dol lars said collector or other principal officer shall publish a notice once a week for three successive weeks in some newspaper of the county or place where such seizure fehall have been made if any newspaper shall be published in said county but if no newspaper shall be published in said county then such notice shall be pub lished in some newspaper of tbe county in which the principal cus toms office of the district ghall be situated and if no newspaper shall be published in such county then no tices shall be posted in proper public places which notices shall describe . the articles seized and state the time cause and place of seizure and shall require any person claiming sdfi articles to appear and file with such collector or other officer his claim to such articles within t*#en-ty days from the date of the first publi cation of such notice sec 12 and be it further enacted lhat any person claiming the prop erty so seized may at any time with in twenty days frrom the date of such publication file with the collector or other officer a claim stating his or her interest in the articles beized and upon depositing witb such col lector or other officer a bond to the united sta fes in the penal sum of two hundred and fifty dollars with two sureties to be approved by such col lector or other officer conditioned that in case of the condemnation of the articles so claimed the obligors shall pay al the costs and expenses of the proceedings to ohtain such con demnation such collector or other officer shall transmit the same with the duplicate list and description of the articles ' seized and claimed to the united states district attorney for the district who shall proceed for a condemnation of the property in the ordinary mode prescribed by law but if no such claim shall be filed nor bond given within the twenty days above specified such collector or oth er officer shall give not less than fif teen days notice of the sale of the property so seized by publication in the manner before mentioned ahd at tbe time and place specified in such notice he shall sell at public auction 1 the property so seized and shall de posit the proceeds after deducting '] the actual expenses of such seizure publication and sale to the credit of the treasurer of the united states as shall be directed by the secretary i os the treasury provided that the i collector shall have power lo adjourn such sale from time to time for a pe riod not exceeding thirty days in all sec 13 and be it further enacted that any person claiming to be in terested in the property sold under the provisions of the proceeding pre ceding section may within threo months a-ft«r m<b tmfo tpp *•» be secretary of the treasury for a re mission of the forfeiture and a resto ration of the proceeds of such sale and the same may be gran ted by said secretary upon satisfactory proof to be furnished in such manner as he shall direct that tbe applicant at the time bf the seizure and sale of the property in question did not know of the ei-sure and was in such cir cumstances m prevented hm from knowing of the same and that said forfeiture was incurred without wil ful n«*gii geqco 0r any j ntention of fraud on the part of the owner of such property sec 14 and be h further ehacted that if no application for such re mission or restoration shall bo made within three months after such sale the secretary of th-e treasury shall then cause the proceeds of such sale to be distributed in this same manner as if such property had been con demned and sold in pursuance of a decree of'a competent court sic 15 and be it further enacted that whenever seizure shall bo made of any property which in the opin ion ol ihe appraisers shall be liable to perish or waste or to bo greatly reduced in value by keeping or can not be kept without great dispropor tionate expense whether such seizure consist bf live animals or goods wares or merchandise and when the property thus seized shall not exceed five hundred dollars in value and when no claim shall have been inter posed therefor as is hereinbefore pro vided the said appraisers if request ed by the collector or principal offi cer making the seizure at the time woen such appraisal is made shall certify on oath in their appraisal their belief that the property seized is liable to speedy deterioratiori or that the expenses of its keeping will largely reduce the net proceeds of the sale and in case the appraisers thus certify such collector or other officer may proceed to advertise and sell the same at auction by giving notice for such time as he may think reasonable but iot less than one week of such seizure and intended sale by advertisement as is herein before provided and the proceeds of g(udh sale shall be deposited to the credit bf the treasurer of tliei united states subject nevertheless to the payment of such claims as ehall be presented within three months from the day of sale and allowed by the seoretary of the treasury sec 16 and pc it further enacted that the secretary of tho treasury shall have authority to ascertain the facts upon all applications for remis sion of fines penalties and forfeit ures incurred or accruing under the revenue laws whore tbe amount in question does not exceed one thou-i sand dollars in such manner and un der such regulationa as he may deem proper and he may thereupon remit or mitigate such fines penalties or forfeitures if in his opinion the same shall have beeft incurred without wil ful negligence or any intention of fraud sec 17 and be it further enacted that whenever the proper officer of the customs shall be duly notified of the existence of alien upon imported goods wares or merchandise in hia custody be shall before delivering such goods wares or merchandise to the importer owner or consignee thereof give seasonable notice ta the party or parties claiming the lien and the possession by the officers of customs shall aot affect the discharge of such liea provided that the rights of the government shall not be prejudiced thereby and the secre tary of the treasury may prescribe all needful regulations to carry this provision into effect and provided that neither the united states nor its officers shall be in any manner liable for losses incurred in conse quence of the omission by rigcide'nt '" and without their fault of officers of the customs to give tbe notice afore said sec 18 and be it further enacted that nothing id this act contained shall be taken to abridge or limit any ! forfeiture penalty fine liability or remedy provided for or existing un der any law now in force except as herein otherwise specially provided sec 19 and be it further enacted that where the value of goods wares or merchandise imported or brought into the united states shall not exceed one hundred dollars the collector is authorized in his discre tion to admit the same to entry with out the production of the triplicate invoice required by the act of march three eighteen hundred and sixty three entitled an act to prevent and punish frauds,"and so forth and without submitting the question to tbo secretary of the treasury pro vided that the collector shall be sat isfied that the neglect to produce such invoice was unintentional and that the importation was in good faitb and without any purpose of de frauding or evading the revenue l*r#s of the united states sic 20 and be it further enacted that if any gd-ods wares or mer chandise shall at any port or place in the united states on the northern northeastern or northwestern fron tiers thereof be laden upon any ves sel belonging wholly or in part to a subject or subjects of a foreign coun try or countries and shall be taken tbenee to a foreign port or place to bt relad-tit tad mefaip-ped to vj oth er port or place in the united states on said frontiers either by tho same or any other vessel foreign or ameru can with intent to evade the provis ions of the fourth section of the act concerning the navigation of the united states approved marefe on eighteen hundred and seventeen tba said goods wares and merchandise shall on their arrival at such last named port or place be seized aiid forfeited to the united states and the vessel shall pay a tonnage duty of fifty cents per ton on her admeasure ment sec 21 and be it further enatudl that all steam tug-boats not of tho united states found employed ia towing documented vessels of tho 1 united states plying from one port bf place in the same to another shall forfeit and pay the sum of fifty cent per ton on the admeasurement of every such vessel so towed by them respectively as aforesaid which surri may be recovered by waj bf libel or suit sec 22 and be it further enacted that if any vessel enrolled or licensed to engage in the foreign and coasting trade on the northern northeastern and northwestern frontiers of the united states shall touch a any port or place in the adjacent british provinces and the master or other person having charge of such vessel sh'i.ll purchase any gooda wares or merchandise for the use of said ves sel said master or other person hav ing charge of said vessel shall report i the same with cost and quabtity , thereof to the collector or other offi cer of the customs at the first port f n j the united states at which he shalt next arrive designating them sea stores and in the oath to be takerl f by such master or other person in charge of such vessel on making said report he shall declare that the arti cles so specified or designated sea stores are truly intended for the us<*f exclusively of said vessel and are not intended for sale transfer or private uso and if upon examination and in spection by the collector or other offi-j cer of the customs such articles are not deemed excessive in quantity fojf the use of said vessels for the voyage on which she is engaged such articles shall be declared free of duty but if it shall be found that the quantity or quantities of such articles or any part thereof so reported a*re excessive ifc shall be lawful for the collector or other officer of the customs to esti mate the amount of duty on such ex cess which shall be forthwith paid by said master or other person hav ing charge of said vessel on pain of forfeiting a sum of not less than ono hundred dollars nor more thanffourr r times the value of such excess or said master or other person having charge of such vessel shall be liable 5 to imprisonment for a term of not less than three months nor more ttfan two years at the discretion of the court and if any other or greater quantity of dutiable articles shall be found on board such vessel than are specified in such report or entry of said articles or any part thereof shatf be landed without a permit from k collector or other officer of the cus toms such articles together with the vessel her apparel tackle and furni ture shall be seized and forfeited provided always that articles purr chased for the use of or for sale od board any steamboat propeller or other vessel as saloon stores or 1 supplies shall be deemed goods wares and merchandise and shalf be liable when purchased at a for eign port to entry and the pay nien t of the duties found to be due there on at the first port of arrival of such vessel in the united states and for a failure on the part of the saloon 1 keeper or person purchasing or own ing such articles to report make en tries and pay duties as hereinß'efow required such articles together with the fixtures and other goods wares or merchandise found in such saloon or on or about such vessel belonging to and owned by such saloon keeper or other person interested in such saloon shall be seized and forfeited and such saloon keeper or other per son purchasing and owning as afore said shall forfeit and pay the sum of not less than one hundred dollars nor more than five hundred dollars and in additibn thereto shall be jms prisoned fof & term not 112 continued an act further to prevent smuggling and for other purposes se it enacted by the senate and mouse oft representatives of the united states of america in congress assem bled that for the purposes of this act the term vessel whenever herein after used shall be held to include eyfery description of water craft raft vehicle and contrivance used or capa ble of being used as a means ot aux iliary of transportation on or by water*.and the term vehicle whenev er hereinafter used shall be held to include evry description of carriage wagon engine car sleigh sled i sledge hurdle cart and other ai-tifi i cial contrivance used or capable of being used as a means or auxiliary of tarusportation on land sec 2 and be it further enacted that it shall be lawful for any officer of the customs including inspectors and occasional inspectors or of a revenue cutler or authorized agent of the treasury department or other person specially appointed for the purpose in writing by a collector tiaval officer or surveyor of the cus toms to go on board of any vessel as well without as within his district and inspect search and examine the same and any person trunk or en velope on board and to this end to hail and stop such vessel if under way and to use all nedessary force to compel compliance and if it shall appear that any breach or violation of the laws of the united slates has been.committed whereby or in con sequence of which such vessel or the goods wares and merchandise or any part thereof on board of or imported by such vessel is or are lia ble to forfeiture to make seizure of the same or either or any part there of and to arrest or in case of escape to pursue and arrest any person en gaged in such breach or violation provided that the original appoint ment in writing of any person spe cially as aforesaid shall be filed in the custom house where such appoint ment is madei sec ' 3 and be it further enacted that any of the officers or persons \ authorized by the second section of i this act to^board or search vessels j may stop search and examine as | well without as within their raspec ! tive districts any vehcle beast or person on which or whom he or they shall suspect there are goods wares or merchandise which are subject to duty or shall have been introduced in to the united states in any manner contrary to law whether by the per son in possession or charge or by : in or upon such vehicle or beast oi otherwise and to search any tfdnk or envelope wherever found in which he may have a reasonable ; cause to suspect there are goods which were imported contrary to law and if any such office or per son so authorized as aforesaid shall find any goods wares or merchan dise on or about any such vehicle beast or person or in any such trunk or envelope which he shall have reasonable cause to believe are sub ject to duty or to have been unlaw fully introduced into tbe united states whether by the person in possession or charge or by in or upon such vehicle beast or other wise he shall seize and secure the same for trial and every such vehi [ cle and beast or either together : with teams or other motive power i used in conveying drawing or pro | pelling such vehicle goods wares or merchandise and all other appurten ances including trunks envelopes covers and all means of conceal ment and all the equipage trap pings and other appurtenances of such beast team or vehicle shall be subject to seizure and forfeiture and if any person who may be driving or conducting or in charge of any such carriage or vehicle or beast or any person travelling,shali wilfully refuse to stop and allow search and exami : nation to be made as herein provided when required so to do by any au thorized person be or she shall on conviction be fined in any sum in the discretion of the court convict ing him or her not exceeding one thousand dollars nor less than fifty dollars and the secretary of the treasury may from time to time proscribe regulations for the search of persons and baggage and tor the employment of female inspectors for for the examination and search of persons of their wn sex and all persons coming into the united states from foreign countries shall be liable to detention and search by authoriz ed officers or agente of the govern ment under such regulations as the secretary of the treasury shall from time to time prescribe provided that no railway car or engine or other vehicle or team used by any person or corporation as common carriers in the transaction of their business as such common carriers shall be subject to forfeiture by force of the provisions of this aot unless it shall appear that the owners su perintendant or agent of the owner in charge thereof at the time of such unlawful importation or transporta tion thereon or thereby was a con senting party or privy to such ille gal importation or transportation see 4 and be it further endted that if any pel-sen shall fraudulent ly or knowingly import or bring into the united states or assist in so do ing any goods wares or merchan dise contrary to law or shall receive conceal buy sell or in any manner facilitate the transportation conceal ment or sale of such goods wares or merchandies after their importa tion knowing the same to have been imported contrary-to law such goods wares and merchandise 6hall be for feited and he or she shall on con viction thereof before any court of competent jurisdiction be fined in any sum not exceeding five thousand dollars nor less than fifty dollars or be imprisoned for tny time not exceeding two years or both at the discretion of such court and in all cases where the possession of 4jieh goods shall be shown to be in the de fendant or where the defendant shall be shown to have had possession thereof such possession shall be deetited evidence sufficient to author ize conviction unless the defendant shall explain the possession to the satisfaction of the jury sed 5 and be it further enacted that any person authorized by this act to make searches and seizures ot any person assisting hitn ot acting under his directions may if deemed necessary by him or them enter into or upon or pass through the lands enclosures and building's other than the dwelling-bouse of any person whomsoever in the night or in the daytime in order to the more effec tual discbarge of bis or their official duties sec 6 and be it further enacted that if ariy person shall forcibly as sault resist oppose prevent impede or intorfere with any officer of the customs or his deputy r deputies or any person assisting them or either of them in the execution of their du ties or any person authorized by this act to make searches or seizures in the execufiin of his duty or shall rescue or attempt to rescue or cause to be rescued any property which shall have been seized by any person authorised a aforesaid or shall be fore at or af er any such seizure in order to prevent the seizure or seeur ing of any goods wares or merchan dise by any person authorized as afyresaid stave break throw ovor ; board destroy or remove the same the person so offending shall for eve ry such offence on conviction there of forfeit and pay a»sum of not less than one hundred dollars nor more than two thousand dollars or shall be imprisoned not less than one month nor more than one year or both at the discretion of the court convicting him or her and shall stand committed until such fine and the costs of prosecution shall have been fully paid and if any person shall discharge any deadly weapon at any person authorized as aforesaid to make searches or seizures or shall use any deadly or dangerous weapon in resisting him in ihe execution of his duty with intent to commit a bodily injury upon him or to deter or prevent him from discharging his duty every such person so offending shall upon conviction thereof be deemed guilty of felony and ehall be imprisoned at hard labor for a term not exceeding ten years nor less than one year sec 7 and be it further enacted that it shall be the duty of the seve ral collectors of customs to report within ten days to tho district attor ney of the district in which any fine or personal penalty may be incurred for the violation of any law of the united states relating to the reve nue in all cases in which such fine or penalty shall not be voluntarily paid a statement of all the facts and cir cumstances of the case within their knowledge together with the names of the witnesses and which may come to their knowledge from time to time stating the provisions of the law believed to be violated and on which a reliance triay be had for a condemnation or conviction and such district attorney shall cause suit and prosecution to be commenced and prosecuted without delay for the fines and personal penalties by law in such cases provided unless upon inquiry and examination be shall de cide that a conviction cannot proba bly be obtained or that the ends of public justice do not require that a suit or prosecution should be insti ] tuted in which case he shall report ; the facts to the secretary of the i treasury for his direction and for expenses incurred and services ren dered in prosecutions for such fines anxi personal penalties the district attorney shall receive such allowance as the secretary cf the treasury shall deem just and reasonable upon the certificate of the judge before whom such prosecution was had and if any collector shall in any case fail to re port to the proper district attorney as prescribed in this section such col lector's share of any fine or penalty imposed or incurred in such case shall be forfeited to the united states and the same shall be awarded to such persons asr may make complaint and prosecute the same to conviction sec 8 and be it further enacted that in any case where a vessel or the owner master or manager of a vessel shall be subject to a penalty for a violation of the revenue laws of th united states such vessel shall be holder for the payment of th j penalty and may be seized and pro ceeded against summarily by libel td recover such penalty in any dis trict court of the united states hav ing jurisdiction of the offence sec 9 and be it further enacted that the act entitled an act further | to regulate the entry of merchandise imported into the united states from | any adjacent territory approved march two eighteen hundred and twenty-one be and the same is here by so amended that wherever iii aaid act the word merchandise occurs the same shall read goods wares or merchandise sfic 10 and be it further enacted that every officer or other person authorized to make searches and ceizuros by this aot shall at the time of executing any of the powers con ferred upon him by this act make known uptm being questioned his character as un officer or agent of the ! customs or government and shall i have authority to demand of any person within the distance of three i miles to assist him in making any ar rest search or seizure authorized by this act where such assistance may be necessary and-if suchpersor.shall without reasonable excuse neglect or refuse so to assist upon proper de mand he shall be deemed guilty of a misdemeanor and shall forfeit a sum not exceeding two hundred dollars nor less than five dollars sec 11 and be it further enacted that in au cases of seizure of proper ty subject to forfeiture for any of the causes named in this act or any oth er aot relating to the customs or the registering enrolling or licensing of vessels now in force when in the opinion of the collector or other prin cipal officer of the revenue making such seizure the value of the proper ty so seized shall not exceed five hun dred dollars he shall cause a list and particular description of the property so seized to be prepared tn duplicate and an appraisement of the same to be made by two sworn appraisers under the revenue lawsj if there are such appraisers at or near the place of seizure but if there are nd such appraisers then by two competent and disinterested citizens of the uni ted states to be selected by hirri for that purpose residing at or near the place of seizure which list and ap pr-aisement shall be properly attested by such collector or other officer aod tht persons making the appraisal and for such services of the apprais ers they shall be allowed out of the revenue one dollar and fifty cents each for every day necessarily era ployed in such service if the amount of such appraisal shall not exceed the sum of five hundred dol lars said collector or other principal officer shall publish a notice once a week for three successive weeks in some newspaper of the county or place where such seizure fehall have been made if any newspaper shall be published in said county but if no newspaper shall be published in said county then such notice shall be pub lished in some newspaper of tbe county in which the principal cus toms office of the district ghall be situated and if no newspaper shall be published in such county then no tices shall be posted in proper public places which notices shall describe . the articles seized and state the time cause and place of seizure and shall require any person claiming sdfi articles to appear and file with such collector or other officer his claim to such articles within t*#en-ty days from the date of the first publi cation of such notice sec 12 and be it further enacted lhat any person claiming the prop erty so seized may at any time with in twenty days frrom the date of such publication file with the collector or other officer a claim stating his or her interest in the articles beized and upon depositing witb such col lector or other officer a bond to the united sta fes in the penal sum of two hundred and fifty dollars with two sureties to be approved by such col lector or other officer conditioned that in case of the condemnation of the articles so claimed the obligors shall pay al the costs and expenses of the proceedings to ohtain such con demnation such collector or other officer shall transmit the same with the duplicate list and description of the articles ' seized and claimed to the united states district attorney for the district who shall proceed for a condemnation of the property in the ordinary mode prescribed by law but if no such claim shall be filed nor bond given within the twenty days above specified such collector or oth er officer shall give not less than fif teen days notice of the sale of the property so seized by publication in the manner before mentioned ahd at tbe time and place specified in such notice he shall sell at public auction 1 the property so seized and shall de posit the proceeds after deducting '] the actual expenses of such seizure publication and sale to the credit of the treasurer of the united states as shall be directed by the secretary i os the treasury provided that the i collector shall have power lo adjourn such sale from time to time for a pe riod not exceeding thirty days in all sec 13 and be it further enacted that any person claiming to be in terested in the property sold under the
