\ sec 12 and be it further enacted that apothecaries who manufacture * for their own dispensation and sales to consumers and td physicians the medicines compounded according to the united states or other national pharmacopoeias or of which the full and proper formula is published in any of the dispensatories now or hitherto in common use among phy sicians or apothecaries or in an pharmaceutical journal now issued by iiny incorporated college of phar macy shall not be regarded as man ufacturers under this act bnt apoth ecaries and all other persons wbcr manufacture for the dispensing and sales of others or who make and ad vertise any article medicinaf or oth erwise simple or compound with any special proprietary claim to mer it or to special advantage in use or effect whether such claim be based on the properties qualites price or any other distinctive or distinguish ing characteristic whether real of pretended of the articles so made and advertised whether such article be or not made according to the-au thorities above cited in this section shall be regarded as manufacturers under this act itc-sec 13 and be it further enacted that no stamp tax shall be imposed upon any uncompo&nded medicinal drug orchemi'eut ndr upon any medi cine compounded according-«4q the united stales or other national phar macopoeia or of which the full and proper formula is published in any ' of dispensatories now or hitherto in common use among physicians or apothecaries or in any pharmaceuti cal journal yiow issued by any incor porated college of pharmacy when not sold or offered for sale or adver , tised undor any oilier name form or guise than that under which they | may be severally denominated and | laid down in said pharmacopoeias | dispensatories or journals as afore said noj upon medicines sold to or for the use of any person which may 1 be mixed and compounded for eaid i person according to the written re ceipt or proscription of any physician or surgcoh but nothing in this sec tion shall be construed to exempt from stamp tait any medicinal articles whethtr simple or compounded by any rule authority or formula pub lished orunpttblished which are put up in a sryle or manner similar to that of patent or proprietary medi cines in general fv advertised iif newspapers or i>y public handbills for popular sale and use as having any special^roprietary claim to merit or to any peculiar advantage fa mode of preparation quality u*o or effect whether such laim be real or pre tended sec 14 and bs it further en'acitd that in ease anj goods or commodi ties for or in rospe-ot whereof any tax is or shall be imposed or any materi als utensil or vessels pfop&r or in tended to be made use of for or in the making of such goods or com modities shau be removed or shall be deposited or concealed in my place | with intent to defrauh the united i state of such tax or any part there of all such gooda an4%ommodites aud all such materials titensils and vesseiß respectively shall be forfeit ed ancfin every such case and in every case wsere any goods or com modities shall be forfeited under ibis act or any tber act of congress re lating to the internal revenue all and singular tho casks vessels cases or other packages whatsoever contain ing or which shall have contained such goods or commodities respect ively a^d everj vessel boat cart carriage or other conveyance what soever and all horses or dtber ani mals and all things used in the re i moval or for the deposit or conceal ment thereof respectively shall be forfeited and every person who shall remove deposit or conceal or be concerned in removing depositing or concealing any goods or commodities for or iii respect whereof any tax is . or shall be imposed with intent to de fraud the united states of such tax or any part thereof shall be liable to a fine or penalty of not exceeding jdve hundrod dollars sse 15 and be it further enttpted tbat th judge of any circuit or dis trict court of the united states or any commissioner thereof may issue a search warrant authorizing any internal revenue officer to search any premises if sucb officer shall make oath in writing 5 that he has reason to believe aad does believe that a fraud npon the revenue has been or is be ing committed upon ot by the use of said premises | sec 18 and be it further exacted ; that in case any person shall sell give or purchase or receive amy h(ft '' ■barrel bag or any vessel package > ; wrapper cover or envelope of any kind stamped branded or marked m any way so as to show that the coh 5 tents or intended contents thereof have been duly inspected or that the i tax thereon has been paid or that any provision of the internal revenue laws has been complied with wheth ! er such stamping branding or mark i ing may have been a duly authorized j actor may bo false and counterfeit i of joth-wwiee ipifcbcfut aafhority of law said box barrel tag vessej package wrapper cover or envelope \ being empty or containing anything 1 else than the contents which were ! therein when said articles had been so lawfully stamped branded or mark ed by an officer of revenue such per ! son shall be liable to a penalty of not lesa than fifty nor more,than five hun dred dollars and any person who shall make manufacture or procmce any box barrel bag vessel package wrapper cover or envelope stamp ed branded or markred as bove de scribed or shall stamp brand or mark ihe same as hereinbefore recit ed shall upon conviction ihcre&f be liable to penally as before provided in this section and any person who shall violate the foregoing pro visions of»this section with i«te*-t to defraud the revenue or to defraud any person shall upo<n conviction thereof be liable to a fine of notlens than one thausarid jior more than five thousand dollars or imprison ment for nor less than six months nor more than five years or both j such fine and imprison ment at the discretion of ihe court and all arti cles sold give-n purchased received made manufactured produced branded stamped or marked in vio lation of the provisions of this sec tion and all their contents shall be forfeited to the united states sec 17 and be it further enacted that where any whiskey oil tobac co or other articles of manu fact nte or produce requiring brands stamps or ma/ks of whatever kind to be placed therein shall be sold upqn distraint forfeiture or other process , provided by law the same not hav ing beea branded stamped or mark ed asj-equirod by law the officer sell ing tho same shal upon sale thereqf . fix or casse to be affixed the brands stamps or marks so required arjd deduct the expense thereof from the proceeds of such sale sec 18 and be it further enacted thatinanual labor schools and col leges shall not be required to pay a manufacturer's or special tax while the proceeds of the labor of such in stitutions are applied exclusive y to the aupport and maintenance-of-such institutions sec 19 and be it further enacted that no suk shall be mantained in any court for lbe recovery of afcy tax alleged to have been erroneously illegally assessed of collected until appeal shall have been duly made to the commissioners of internal eeve nue according to tho provisions of law in that regard and the regula tions of the secretary o the treasu ry established in pursuance thereof and a of said commissioner shall be had thereon unless such suit i shall ba brought within siemon tbs { from the time of said decision or within six months from the tim this act takes effect provided that if said dicisipn shall be delayed more than six months from the date of such appeal then eaid suit may jbe brought at hy time w||,hin twelve booths from the date of such appeal sec 20 and be it further enacted that section fifteen of the act of march three eighteen hundred and sixty-five entitled an act to aro^d an act entitled an act to provide internal revenue to support the gov ernment to pay interest on the pub lic debtj and for other purposes approved june thirty eighteen hun dred and ixty-four be amended by striking out all after ihe enacting clause ahd iri&erting in lieu the following that in any part of tbo united states in which there is more than one collector of internal revenue the secretary of the treasu ry may designate one of said collec tors to have charge of all matters relating to the exportation of articles subject to tax under the laws to pro vide internal revenue and ht such ports as the secretary of the treas ury may deem it necessary there shall be an officer appointed by him to superintend all matters of expor tation and drawback under the di rection of the collector whose com pensatiofi therefore shall b prescri bed by the secretary of the treasury \ but shau not exceed in any ease an annual rate of two thousand dollars ' excepting at new york where the ! compensation shall be an annual rate of three thousand dollat-s and all the books papers and documents ; in the bureau of drawback in the j respective ports relating to the drawback of taxes paid uftdet the interanl revenue laws shall be de livered to said collector of internal revenue and any collector of inter nal revenue or superintendent of ex ports and drawbacks shall have au thority to administer such oaths and certify to iuth papers as may be i necesßsary nndet any rules and reg ulations that may be prescribed un der the authority berein conferred sec 21 and be it further enacted that every person firm or corpora tion if ho distils or manufactures spirits ot alcohol by continuous dis tillation from grain who brews or makes mash wort or wash for dis tillation or tbe production of spirits shall be deemed a distiller under this act and the making or keeping by any person of grain mash wash or beer prepared or fit for distillation together with the possession by such person of a stilt or other appa ratus capable of use for distilling upon the same premises shalf be dee!£*d tike a pfeeampti*r evidence that such person is a dis tiller within the meaning of t^is act sec 22 and be it further enacted that every person firm or corpora tion who rectifies purifie or refines distilled spirits or wines by any pro cess or<-who by mixing distilled spir its or wines with any materials man ufactures any spurious imitation or compound liquors for sale under the bame of whisky brandy gin rum wine spirits or wine bitters or any other name shall bo regarded as a rectifier uqder this act s.kaj23 and be it further enacted that if any person shall carry on the bu^inefsof a distiller cr rectifier with out having f aid the special tax as re quired by law he ghall for every such oftence be ifable to a fine of not hjjsa tbcin double the tax imposed upon the spirits distilled or double the special tax due for the spirits rectified by such person or found upon the prem ises hereinafter mentioned and to im prisonment for a term not-exceeding , two years and all spirituous liquors so distilled or rectified or owned by such person or found as hereinafter mentioned and fell materials for mak ing r preparing the same and alt vessels containing the same and all stills or other apparatus capable of being used foi distilling owned by such person orfuund tipdn an prem ises where such business shall be ear tied on in violation of this section shall be-forfeited to the united states and may b seized by 4hecollector or deput collector of the district with ' in which such offence is-committed sj:c 2-1 and be u furtier enacted that any person engaged in or in tending to engage in the business of a distiller or rectifier shall give tio 1 tic in writing subscribed by him to i the assessor of tbe district within which such business is to be carried on stating the name tor style under which tne name or names and the place or places f residence of ihe person or persons b whom and the place where sftid buisftess ia to be carried on and whether of^distilling or rectifying in case & distiller the notice shall also st-ate tho kind of stills boilers and other implements to be used the capacity of each tho ihamo or name of the owner or own ers the premises on which the dis tillery is or is to b situated and if such premises are leased tbe terms of the lease in case of any cfiafrge in the location form capacitj own ership agenc or of such distillery stilts boilors or other implements like noticef shall be given as aforesaid within twenty four hours of such change such person shall also give bond inform to be prescribed by the commissioner of internal revenue with sureties approved by the collector of the dis trict who may approve the same if he shall be satisfied by affidavits made on said bbnd of the sufficien cy of said sureties conditioned that he will comply with aji the require ments of the law in relatioh tq dis tilled spirits xho penal surd ofsush bond shall not be more thau double the am6unt of the tax on the spirits that can be distilled by such still or ! stills or other implements during a ! period cf fifteen days baid col lee ! tor may refuse to approve aid bond when in hix judgement the location bf the distillery is such as would en able the distiller to defraud the reve nuo and in case of such refusal the distiller may appeal to the com ■missioner of internal revenue whose decision in the matter shall bo final a new bond may be required in case of t&e death insolvency or removal ' of either of t,ho sureties or in any otber contingency at the discretion of the collector any person failing ' to give the notice or bond hereinbe fore required/-or give a false or fraud j ulent notice shall be liable tq the ] fine and fo-feiture provided in tb"e last preceding section sec 25 and be it further enacted that nd person shall use any mill boiler or other vessel for the pur pose of distilling in any building of on any premises where beer lager beer ale,_porter or other fermented j liquors vinegar or ether are man ufactured or produced or where sugars or sirups are refined or wbera liqudrs of any description are retailed or any other business is carried oif or in any dwelling-house ; apd every persoq who shall use such etiji boil er or other vessel for the purpose of distilling as aforesaid m any building og other premises whe*re tho above specified articles are manu factured produced f or other business is carried on or in any dwelling house or who shall procure the same to be done shall forfeit such stills boilers or otber vessel 8o used and sll the spfirita distilled and pay a fine of one thousand dollars or be imprisoned for not jmore than oae year in the discretion ef the court j aftd any person v*/ho shall maodfae taro any still boiler or otber vessel w be used fo the pnrpose of distill ing shall before th same is re moved from tbe place of manufacture notify the collector where sacb stilf boiler or othef fesriel is to be used or sent and by whom it is to be nsed and o its capacity and the t|me when the same is to be sent or set up j and no such stih bolter or other vassal shall be set np without the permit in writing of the collector for that pufposej and any persbta i wso shall set ap bach still boiler or ► otber yesßel i fbc>%s fires obt^-ming a permit from the collector ojtthe district in which subh still boiler or other vessel is intended to be used . or who shall fail to give such notice shall pay in either case the sum of five huodred dbil&rs arkt sball for feit tbe distilling apparatus ihns re moved or set up in violation of law : prqvided that salet-atus may be made or manufactured in any build ing or on any premises where spirits are distilled provided further that any boiler used in generating steam or heating water to u8 uaed in such distillery may be located in any other building or on any other prem ises to be connected with such still or boiling tubs by suitable pipes dr other aparalus or the steao from such boiler in the distillery may be conveyed to other premises to be used for manufacturing or other pur poses sin 6 26 and be ii further enacted that ever rectifier or wholesale deal er m distilled spirits shall enter daiiyj in a book or books kept for that pur pose urrdfr such riiles and regulations asuhe commissioner of internal rev enue may prescribe the number of proof gallons of spirits purchased or received whom purchased and re ceived and the number of proof gal < ions sold or delivered and every rec-t tiller or wholesale dealer who shall neglect or refuse to keep such record shall forfeit all spirits in his posses sion together wfth t^e apparatus tools and implements used and be subject-to a fine of five hundred dol lars or imprisonment for not less than six months nor niore than one year in the discretion of the court and every rectifier shall mark on each package of five gallons or piore of distilled pr rectified spirits sold by him his name and place of bueiness sec 27 t and be it further enacted that tbe owner or ownors"of any dis tillery shall provide at his or their own expense a warehouse suitable for the storage of bonded spirits of his oi*2 their own manufacture oply or be or they maj t provide a secure : room in a suitable building to he used as such warehouse but fib dwelling house shall be used for that pttrposdj and po door window,.or other open ing shall be made or permitted in the v^alls thereof leading to-any other room or building ufce/i for any other purpose or into tbe distillery ; and after a bond has been given as here inafter provided such warehduae or room when approved by the secreta ry of the treasury on report of the district collector is hereby declared to be a bonded warehouse of the uni ted states and shall bo used only for tho storing of spirits manufactured by th4o[w]nor agent or superinten dent of such distillery and shall be under the custody of the inspectdr as hereinafter provided nd shall be kept locked up by the proper officer in charge at slfl times except when he shall be present and the tax on the spirits stored in such warehouse shall be paid before removal from „ such warehouse unless removed in pursuance of law and the owner or owners of such warehouse shall exe cute a general bond to the united states with two oi more sureties to jie approved by the collector and such bond shall be for not less jthan the amount of taxes on the spirits to be covered thereby and jn such form and containing such conditions as shafl be approved by the secretary of the treasury and shall b"'e changed or renewed from time to time in re gard to the amount 3nd sureties there of as the collector with the approval as the secretary of treasury may require sec 29 and be it further enacted that general bonded for the storage of-spirits or other mer chandise allowed by law to be placed in bond to secure the payment of the internal revenue tax thereon or the exportation thereof may be estab lished under such rules and trpgula tions and upon the execution of such bonds as the secretary of the treas ury may prescribe and.shall be in the immediate custody of storekeepers ; who shall be appointed for that pur pose whose compensation shall be paid monthly totbe collector of the district by the owners or proprietors of sucb warehouse and shall not ex ceed the ratea which may be allowed to storekeepers of b'dnfdea warehouses established under the laws and regu lations relatinglo customs provided that any article manufactured n a bonded warehouse established under the one hundred snd sixty eighth seo tion of the internal revenue act of june thirtieth eighteen hundred and fei£ty-fouf and located in any of the atlantic states muy be removed therefrom for transportation to a cus toms bonded warehouse at any port on the pacific coast of the united states for the purpose only of being exported therefrom under such rules and regulations and upon the execu tion of suck bonds or other security the secretary qf the troastfry may prcsdrfbe sec 29 and be it further enacted , that there shall be appointed fry the secretary of ttfe treasury^n inspec tor for every distillery established according td la^r who shall take an oath faithfully to perform his duties aud who khali lake an account of all the meal and vegetable productions or ' other substances to be nsed for tho parpose of producing spirits whew pnfc revenue and shall take charge of the bonded warehouse es tablished for the distillery in conform ity to law and such warehouse shalt be in the joint custody of such in spector and the owner thereof his agent or superintendent and whejr-j any spirits seall be placed in such warehouse an entry therefor in sneh form as shall be prescribed by fregit lations shall immediately be madd and t-igned by s the dwnei of said spir its and shall have endorsed thereon a certificate of the inspector that th spirits mentioned bave been duly in spected and received iti*-laid ware house and such entrf and certificate shall be filed with the-collector of thi distriot and said inspector shall nod engage in any other business while employed as an inspector and shal be paid five dollars per day fbr the time which he is engaged > aud the amount of compensation thus paid for inspection shall be assessed by the assessor upon the distiller and return ed to the collector monthly forcot t lection and in addition to the above componsatidqj sdeh inspectpr shall receive sucb fee as may be preserved hy the commissondr of internal jßevenue for each and every proof gallon of distilled spirits inspected by him and removed to tbe boad-ld ware house which shall be paid by the dlstiile or ovvher.of tho spirits hot no compensation shall be allowed to such inspector for more that one tri speetion of suoh spirits and in sasa the duties of such inspector shall be greatdr at any time than he can per form upon the joint application of the inspector and owner of such dis tillery the secretary of tbe treasu ry may appoint an assistant inspect or and upon the refusal of the distil ler to join in sucb application h4 oouector shall decide as to such fee ceseity and iucb assistant inspector . shall qualify in the same manner an 4 be subject to the samfc penalties a febs inspector and ho shall be paid in ( the same manner as tho inspector at a rate not exceeding the sum of three dollars per day while so temporary charge of sdeh distiller and warehouse who shall during such absence perform the du ties receive the same rate pf pay and be paid in tbe same manner as said inspector or assistant for the time he may be so employed ; pfovid ed that the owner agent,,or super intendent of any distillery who snail 9se cause or permit to be used any materials for tho purpose of produc ing spirits or phall cape girardeau argus vol iv cape girardeau missouri thursday november 1 1866 no 21 laws of tke united states officiai^-by authority j passed at the first session of ihe 39th tpußlic—no lu.]—continued \ sec 12 and be it further enacted that apothecaries who manufacture * for their own dispensation and sales to consumers and td physicians the medicines compounded according to the united states or other national pharmacopoeias or of which the full and proper formula is published in any of the dispensatories now or hitherto in common use among phy sicians or apothecaries or in an pharmaceutical journal now issued by iiny incorporated college of phar macy shall not be regarded as man ufacturers under this act bnt apoth ecaries and all other persons wbcr manufacture for the dispensing and sales of others or who make and ad vertise any article medicinaf or oth erwise simple or compound with any special proprietary claim to mer it or to special advantage in use or effect whether such claim be based on the properties qualites price or any other distinctive or distinguish ing characteristic whether real of pretended of the articles so made and advertised whether such article be or not made according to the-au thorities above cited in this section shall be regarded as manufacturers under this act itc-sec 13 and be it further enacted that no stamp tax shall be imposed upon any uncompo&nded medicinal drug orchemi'eut ndr upon any medi cine compounded according-«4q the united stales or other national phar macopoeia or of which the full and proper formula is published in any ' of dispensatories now or hitherto in common use among physicians or apothecaries or in any pharmaceuti cal journal yiow issued by any incor porated college of pharmacy when not sold or offered for sale or adver , tised undor any oilier name form or guise than that under which they | may be severally denominated and | laid down in said pharmacopoeias | dispensatories or journals as afore said noj upon medicines sold to or for the use of any person which may 1 be mixed and compounded for eaid i person according to the written re ceipt or proscription of any physician or surgcoh but nothing in this sec tion shall be construed to exempt from stamp tait any medicinal articles whethtr simple or compounded by any rule authority or formula pub lished orunpttblished which are put up in a sryle or manner similar to that of patent or proprietary medi cines in general fv advertised iif newspapers or i>y public handbills for popular sale and use as having any special^roprietary claim to merit or to any peculiar advantage fa mode of preparation quality u*o or effect whether such laim be real or pre tended sec 14 and bs it further en'acitd that in ease anj goods or commodi ties for or in rospe-ot whereof any tax is or shall be imposed or any materi als utensil or vessels pfop&r or in tended to be made use of for or in the making of such goods or com modities shau be removed or shall be deposited or concealed in my place | with intent to defrauh the united i state of such tax or any part there of all such gooda an4%ommodites aud all such materials titensils and vesseiß respectively shall be forfeit ed ancfin every such case and in every case wsere any goods or com modities shall be forfeited under ibis act or any tber act of congress re lating to the internal revenue all and singular tho casks vessels cases or other packages whatsoever contain ing or which shall have contained such goods or commodities respect ively a^d everj vessel boat cart carriage or other conveyance what soever and all horses or dtber ani mals and all things used in the re i moval or for the deposit or conceal ment thereof respectively shall be forfeited and every person who shall remove deposit or conceal or be concerned in removing depositing or concealing any goods or commodities for or iii respect whereof any tax is . or shall be imposed with intent to de fraud the united states of such tax or any part thereof shall be liable to a fine or penalty of not exceeding jdve hundrod dollars sse 15 and be it further enttpted tbat th judge of any circuit or dis trict court of the united states or any commissioner thereof may issue a search warrant authorizing any internal revenue officer to search any premises if sucb officer shall make oath in writing 5 that he has reason to believe aad does believe that a fraud npon the revenue has been or is be ing committed upon ot by the use of said premises | sec 18 and be it further exacted ; that in case any person shall sell give or purchase or receive amy h(ft '' ■barrel bag or any vessel package > ; wrapper cover or envelope of any kind stamped branded or marked m any way so as to show that the coh 5 tents or intended contents thereof have been duly inspected or that the i tax thereon has been paid or that any provision of the internal revenue laws has been complied with wheth ! er such stamping branding or mark i ing may have been a duly authorized j actor may bo false and counterfeit i of joth-wwiee ipifcbcfut aafhority of law said box barrel tag vessej package wrapper cover or envelope \ being empty or containing anything 1 else than the contents which were !
